Collaborative Law
Morck Family Law advocates the collaborative family law approach to divorce, which aims to settle disputes amicably without litigation, similar to Alternative Dispute Resolution. If both parties agree, disputes can be reduced to enforceable judgments through negotiations among the parties and their counsel. Most, if not all, of the litigation and adversarial process can be avoided. The collaborative law process is committed to keeping divorce cases out of the courtroom.
Our attorneys work closely with each client and his or her family to determine their priorities and create a plan for achieving them. This collaboration also may involve sessions with other experts, including financial advisors, psychologists and family counselors.
Through this collaborative method, property and custody disputes can be resolved much more quickly, saving time, money and reducing the emotional impact and animosity of the dissolution process. Negotiations are conducted in 4-way meetings between both parties and their counsel. By law, attorneys representing parties in a collaborative divorce cannot represent them in litigation if negotiations fail. This motivates attorneys on both sides of the table to work diligently toward a resolution.
